The European Commission has taken its first major enforcement actions under the Digital Services Act (DSA), issuing substantial fines to two prominent social media platforms. The penalties underscore the EU's commitment to enforcing its comprehensive digital regulations.

Violations Identified

Investigations revealed that the platforms failed to implement adequate systems for identifying and removing illegal content, did not provide sufficient transparency in their advertising practices, and fell short of requirements for protecting minors online. Both companies were also found lacking in their risk assessment and mitigation obligations.

Regulatory Framework

The DSA, which became fully applicable in February 2024, requires very large online platforms to take proactive measures to address systemic risks, including the spread of illegal content and the manipulation of services. Platforms must also provide researchers with access to data for studying systemic risks.

These enforcement actions set an important precedent for digital platform regulation globally. Other jurisdictions, including the UK and Australia, are closely watching the EU's approach as they develop their own digital safety frameworks.
